(“TERRATEK METAL” or the “Company”), we have prepared this Clarification Notice in our capacity as the data controller under Law No. 6698 on the Protection of Personal Data (“KVKK”) in order to inform you about the processing of your personal data.

Your personal data is processed in accordance with the principles set forth under the KVKK and applicable legislation, in compliance with the law and the principles of good faith, ensuring that the data is accurate and, where necessary, up to date; processed for specific, explicit and legitimate purposes; relevant, limited and proportionate to the purposes for which it is processed; and retained for the period stipulated under the applicable legislation or for as long as necessary for the purposes for which it is processed.

It has also been observed that the Company’s website contains a map/iframe component provided through Google infrastructure. Therefore, the Google services used on the website should be technically reviewed separately with regard to personal data processing and international data transfer requirements.

4. What Are the Legal Grounds for Processing Your Personal Data?

Your personal data is processed based on one or more of the applicable conditions for processing personal data set forth under Article 5 of the KVKK.

Within this scope, your personal data may be processed based on one or more of the following legal grounds:

a) It is expressly provided for by law;

b) It is necessary for the establishment or performance of a contract, directly related to the parties to the contract;

c) It is mandatory for the data controller to fulfill its legal obligation;

ç) It is mandatory for the establishment, exercise or protection of a right;

d) It is mandatory for the legitimate interests of the data controller, provided that it does not prejudice the fundamental rights and freedoms of the data subject;

In cases where none of these conditions applies, your explicit consent will be obtained where such consent is required for the relevant personal data processing activity.

The obligation to provide information and the requirement to obtain explicit consent are separate obligations. Even where explicit consent is required, the relevant data subject is separately provided with the necessary clarification regarding the processing of their personal data.

Your personal data may be transferred, to the extent required by the purposes of processing, to the following categories of recipients in accordance with Article 8 of the KVKK and the conditions set forth under applicable legislation:

Your personal data may be transferred to authorized public institutions and organizations for the following purposes:

  • Conducting legal processes.

Suppliers and Service Providers

Your personal data is not used or transferred for purposes other than those specified above, and the principle of being relevant, limited and proportionate to the purpose is observed during data transfers. Specifying the purposes of transfer and the categories of recipients in this Clarification Notice is required within the scope of the Company’s obligation to inform data subjects under the KVKK.

6. Is Your Personal Data Transferred Abroad?

If it becomes necessary for the Company to transfer your personal data abroad, such transfer shall be carried out in accordance with the conditions set forth under Article 9 of Law No. 6698 on the Protection of Personal Data and applicable legislation.

Depending on the nature and legal requirements of the transfer, your personal data may be transferred abroad where an adequacy decision is available, where the appropriate safeguards prescribed under the Law have been provided, or where other transfer conditions stipulated under applicable legislation are met.

7. How Long Is Your Personal Data Retained?

Your personal data is retained for the periods prescribed under applicable legislation. Where no specific retention period is prescribed by legislation, your personal data is retained for as long as necessary for the purpose for which it is processed.

The following criteria are taken into consideration when determining retention periods:

  • Legal obligations,

  • Statutory limitation periods,

  • Contractual relationships,

  • The possibility of legal disputes,

  • Processing purposes.

When the reasons requiring the processing of personal data cease to exist, such personal data shall be deleted, destroyed or anonymized in accordance with applicable legislation.

Under Article 11 of the KVKK, as a data subject, you have the following rights:

a) To learn whether your personal data has been processed;

b) To request information regarding the processing of your personal data if it has been processed;

c) To learn the purpose of processing your personal data and whether such data is used in accordance with its purpose;

ç) To know the third parties to whom your personal data is transferred within or outside Türkiye;

d) To request the correction of your personal data if it has been processed incompletely or inaccurately;

e) To request the deletion or destruction of your personal data within the conditions stipulated under Article 7 of the KVKK;

f) To request that the correction, deletion or destruction of your personal data be notified to third parties to whom your personal data has been transferred;

g) To object to a result arising against you as a result of the analysis of your processed data exclusively through automated systems;

ğ) To claim compensation for damages if you suffer damage due to the unlawful processing of your personal data.

9. How Can You Exercise Your Rights?

You may submit your requests within the scope of Article 11 of the KVKK to TERRATEK METAL in accordance with the application procedures stipulated under the KVKK and applicable legislation.

10. Effective Date

This Clarification Notice has been prepared by TERRATEK METAL for the purpose of informing data subjects about the Company’s personal data processing activities.

This Clarification Notice may be updated in line with changes in the Company’s personal data processing activities or amendments to applicable legislation.
